Dion to Mortgage Electronic Reg­istration Systems, Inc., as nomi­nee for Countrywide Home Loans, Inc. dated December 12, 2006 and recorded in Book 182 at Page 182 of the City/Town of Fairfax Land Records, of which mortgage the undersigned is the present holder by Assignment of Mortgage re­corded on February 9, 2009 in Book 195 at Page 666, for breach of the conditions of said mort­gage and for the purpose of fore­closing the same will be sold at Public Auction at 1:15 p.m. on February 12, 2013 at 30 Fletcher Road # 101, Fairfax, VT 05454 all and singular the premises de­scribed in said mortgage,

To Wit:

PARCEL NO. 1: Being a parcel of land with a blacksmith’s shop located thereon on the westerly side of the highway known as Mills Street in the Village of Fairfax, owned by Nellie J. Rooney; and bounded substantially as follows: on the north by land and premises now or formerly of Fairfax Sales, Inc., on the east by Mills Street, and on the west by the Parmlee Brook of Mill Brook, so-called, and on the south by land and premises of the Methodist Church.

PARCEL NO. 2: Containing one acre, more or less, and bounded as follows: On the north by the eastern ex­tremity of lands and premises now or formerly of F. C. and Rena Stewart; on the east and south by Mill Brook; and on the west by the small drainage brook which emp­ties into Mill Brook. Said parcel of lands has north and south bound­aries of 360 feet in length and east and west boundaries of 150 feet at the widest points. All di­mensions are more or less and are governed by monuments.

PARCEL ID#: FR0030A Being the same premises con­veyed to the herein named mort­gagor( s) by deed recorded with Fairfax Town Office-Land Re­cords at book 137 page 565.

Plaintiff may adjourn this Public Auction one or m ore times for a total time not exceeding 30 days, without further court order, and without publication or service of a new notice of sale, by announce­ment of the new sale date to those present at each adjourn­ment. Terms of Sale: $10,000.00 to be paid in cash or by certified check by the purchaser at the time of sale, with the balance due at closing. Proof of financing for the balance of the purchase to be provided at the time of sale. The sale is subject to taxes due and owing to the Town of Fairfax.

The Mortgagor is entitled to re­deem the premises at any time prior to the sale by paying the full amount due under the mortgage, including the costs and expenses of the sale.

so this isnt a tax sale its a repo sale??????????

I'm not sure what it is Ed.  It was in this morning's Burlington Free Press and I think it said for at least a couple more weeks.  It looked like the place has been empty for a while.
