SUMMARY OF INCIDENT:
On 11-14-2013 at approximately 1430 hours, members of the Vermont State Police responded to a single motor vehicle crash on VT Rt 104 near the intersection with Rocky Ridge Rd in Fairfax, VT.
The damaged vehicle was located in a ditch off of VT Rt 104 and was found on its side. The operator of the vehicle was transported for head injuries to NWMC and then later identified as 27 year old XXXXXXXX X. XXXXXXX, from Fairfax, VT.
XXXXXXX's behavior and the odor of intoxicants suggested that he was driving while under the influence. XXXXXXX was unable to participate in the roadside tests due to his current medical condition. However, XXXXXXX provided a preliminary breath test that was nearly 2 times the legal limit of 0.08% BAC.
XXXXXXX was then arrested and asked to provide an evidentiary blood sample. XXXXXXX refused to provide a blood sample.
XXXXXXX was released and issued a citation to appear in Franklin District Court on December 9th, 2013 at 1300 hours for DUI #1.
