PUBLIC HEARING

FAIRFAX DEVELOPMENT REGULATIONS

Scheduled for Monday October 25, 2010 at 7:00 P.M.
at the Bellows Free Academy Multi- Purpose Room

Notice is hereby given to the residents of the Town of Fairfax, Vermont that the Fairfax Planning Commission will hold a hearing on October 25, 2010 at 7:00 P.M. at the Bellows Free Academy Multi-Purpose Room to consider for adoption the proposed Town of Fairfax Development Regulations pursuant to Chapter 117 of Title 24, §4384 and §4441, V.S.A.  These Development Regulations will modify and replace the current Zoning Bylaws and Subdivision Regulations.

The Development Regulations affect the entire Town of Fairfax.  The purpose of these regulations is to implement the Fairfax Town Plan, to further the purposes of the Vermont Municipal and Regional Planning and Development Act and to promote the public health, safety, comfort, convenience, economy and general welfare of the community. 

These proposed regulations include nine general sections: Authority and Purpose; Zoning Permits; Special Approvals; Subdivision Approval; General Regulations and Review Standards; Specific Use Standards; Planning and Design Standards; Administration and Enforcement; and Definitions.  A full text of the draft regulations, including a summary of major changes, is available at the Fairfax Town Clerk’s Office and may be downloaded from the project webpage:  www.nrpcvt.com/fairfaxzoning.html.  Comments should be forwarded in writing to the Fairfax Planning Commission, PO Box 27,  Fairfax, VT 05401

The proposed new zoning regulations will allow much more development in Fairfax. Do we really want to abandon almost all the zoning controls that have been in place for many years? If this is approved, new lots can be created that have no frontage on a public or private road, multiple lots on one driveway, creation of small lots in all zoning districts (PUD). Seems like almost any project could be either approved or denied based on the discretion of whoever happens to be on some future DRB. Should be an interesting meeting on October 25.
