SUMMARY OF INCIDENT:
During the morning hours of November 18, 2011 the VT State Police initiated
traffic stop in a residential neighborhood in Georgia.  The operator of the
vehicle was identified as 40 year old Daniel “Danny” Francis.  After a roadside
investigation the vehicle was seized by Troopers because they suspected it
contained drugs and stolen property.  Francis was released at the scene and left
with a family member.

The vehicle was seized and a search warrant was obtained later in the day.  The
Troopers were able to locate  several items that had been recently stolen from a
home in the Chittenden County area as well as regulated drugs.

The Vermont State Police are currently seeking Daniel “Danny” Francis in connection
with these crimes.  Anyone with information regarding his whereabouts is asked
to contact Crime Stoppers or the Vermont State Police.

I'm confused here. If there was enough cause/evidence/suspicion to seize the vehicle, why couldn't they hold him for questioning for a few hours until they got the search warrant instead of releasing him at the scene? It seems like an unnecessary effort and expense to try to find him when they already had their hands on him.

It's stoopid but that's what we are stuck with.

Sounds like he didn't give the troopers permission to search the vehicle on the roadside stop.  Officers obviously suspected he had something and had enough reasonable suspicion to obtain a warrant, but those take time to obtain.  they didn't have the items needed to charge him with the crime before they searched the vehicle.  That damn 4th Amendment lol.

LOCATION (specific):Interstate 91N, in the Town of Springfield

VIOLATION: Possession of Cocaine, Possession of Marijuana, Possession of Heroin, Possession of a Loaded Long Gun in a Motor Vehicle.

ACCUSED: Timothy MacLean                       
AGE: 30

CITY, STATE OF RESIDENCE: Saxtons River, VT

SUMMARY OF INCIDENT: On 11/10/11, at approximately 0036 hours, I stopped Timothy Maclean's vehicle on Interstate 91 north, in the Town of Springfield, Vermont for erratic operation.  During the stop, I observed that there were injection marks on his arm and hand.  I later learned that there was were heroin bags and heroin paraphernalia inside the vehicle.  At the completion of the stop, MacLean was released, the vehicle was seized and a search warrant was later applied for and granted.  The following day, I searched the vehicle was conducted and during the search of the vehicle, 5 pounds of marijuana, 9 bags of heroin, a small amount of cocaine and a loaded long gun were located. An arrest warrant for MacLean had been requested.
