A delayed Fairfax development project is getting closer to being constructed.  John Workman and David Modica have filed a minor Act 250 application to construct phase one of a residential building project off Route 104 in Fairfax.

The development, which includes a 47-unit elderly housing project and 14 single family homes, has been plagued by delays for four years.  Last fall, the District 6 Environmental Commission determined that 22 of the 35-acre tract contains agricultural soils as defined by Act 250.

In June, Workman and Modica paid the state $63,000 for agricultural soils mitigation in order to pursue the project in the growth center here.

No hearing will be convened unless a party submits a written request to the District 6 Commission on or before Sept. 24.
