7:00 PM   -  FLANDERS – RECONVENED SKETCH PLAN  - 50 FLANDERS ROAD

 

7:30 PM   The minutes from March 17, 2010 were reviewed. B. Murphy made a motion to approve the General Minutes March 17, 2010.  C. Rainville second.  All in favor.   B. Murphy made a motion to approve the Mill’s Minutes from March 17, 2010.  J. Beers second.  All in favor.  B. Murphy made a motion to approve the Flanders’ Minutes from March 17, 2010.  J. Beers second.  All in favor.

 

One project was added to the schedule:  a revision for O&R Realty (Bushey), on April 21 at 7:15 PM.

S. Taylor asked the Board a question regarding a boundary adjustment request.  He presented two maps: the first showing the two properties as they exist, and the second showing the properties after the desired changes would be made.  After discussion regarding the irregular shape, the Board agreed that even though the new lot would be an irregular shape, it follows the contours of the land and fits within the guidelines of the regulations.

S. Taylor will inform the applicants that he can review the Boundary Adjustment and present it at a Public Hearing. 

 

S. Taylor also asked the Board about an approved Planned Unit Development (PUD).  The developers have four (4) more lots that they would like to have added to the PUD.  The lots were previously approved by the State, but not by the Town.  After discussion, the Board agreed that the project could be brought back as a revision to the PUD.

FLANDERS – RECONVENED SKETCH PLAN REVIEW

50 FLANDERS ROAD

                           M. Averill

 

7:00 PM    M. Averill, Engineer, made the presentation.  The new lot will be at the very end of Flanders Road.  There will be a 50 foot wide ROW for access.  A person from the State Wetlands Department  looked at the property.  The new lot will not be encumbered by wetlands or elevation.  Per Catherine Dimitruk, NRPC, the two existing homes can remain on the one lot, without further subdivision.  This would mean that this current project will be a two (2) lot subdivision, with only one new lot for a new home.  M. Varney asked about frontage on Rte 104.  Reference was made to the new map.  Any easement for the power line will have no impact on the new lot.  The new lot may tie into an existing shallow well.  B. Murphy asked about the location of the septic.  This has not yet been determined.  They may need a septic easement. 

 

The ROW will be an extension of Flanders Road.  The Town Road ends at the existing hammerhead.  J. Beers questioned if the new lot will have 200 feet of frontage.  This will be accomplished by the ROW, as an

“other approved access”.  After discussion it was agreed that this access is an uninterrupted existing lane.  J. Heyer wanted confirmation that the existing stone wall on the property would not be moved.  B. Murphy asked if the development meets the Planning Standards.  S. Taylor said there were no outstanding issues.  Garbage collection will be on the Town portion of the road.    There was no public input.

 

No site visit is needed.  This was declared as a minor subdivision.  The Board agreed that the project can move on to the final hearing. 

 

 

ACTION ITEMS:

   1.   Driveway to be built to Town of Fairfax standards.

HENNING – PRELIMINARY PLAT REVIEW

11 HUNT STREET

7:45 PM    Introductions were made, the Public Notice was read, and attendees signed in. Interested parties were sworn in.

S. Ruggiano, Engineer made the presentation.  The project is a 4 lot Planned Unit Development (PUD) in the Growth Center.  Lot 1 is the existing home-site on Hunt Street. Three (3) new lots, each with a duplex, will be on a new street, Bluevale Street, off of Old Academy Street – directly across from the existing cul de sac.  The new lots will have municipal sewer and on site drilled wells.  The utility lines will be underground. 

 

Many issues were discussed:

                Sidewalks- S. Taylor questioned the sidewalks against the curbs would be difficult to maintain in winter.

                                       S. Ruggiano stated that due to space constraints and sloping, it is the best location. 

                Stormwater drainage – Storm water will drain into the existing Storm water system in the Old Academy Street Development.

                Grading plan for roadway. 

                 S. Ruggiano stated that the final paving of Old Academy Street will be done after the last house in the development is built.

                           There are weak spots with only 1 ½ inches of pavement.

                Sewer – a short section of the sewer line will need to extended.

The open space common land was discussed in length.  The access to the common land probably will be taken off the plan with the expectation of natural growth in that area.  Cedar hedges were brought up as a possible way to show the boundaries of the common land.  B. Murphy asked about the back yards for the duplexes and if there is still room for the common land. 

 

Public Comments:

                G. Brault:  G. Handy will be widening Old Academy Road over the next two years. He will have the road ground up and

                       Will re-do the base and pavement.                            

                K. Haddock:  Questioned the distance of the buffer between the closest duplex and both the school property and her home.

                     (about 25 ft to school property,  about140 feet to her home).  People cutting through yards are a common occurrence.

                     She Prefers hedges to fences for the boundary of property.  She also had a question on the 60 foot ROW and how close it

                     would be to her property. (Approximately 30 feet from the edge of the ROW to the Haddock’s house.)

                M. Stewart:  Students going through the Henning’s property usually happens outside of school hours. Many other people

                     also cut through.  She also mentioned drainage issues - water backs up into the school property near the gazebo area.

                J. Ertl:  Questioned use of common land, and the need for visible boundaries. Concerned about the privacy of her back yard.

                        Concerned about heavy construction equipment on Old Academy Street.         

               B. Taylor and R. Ertl:  They own the ravine. They are concerned that it will not stay as private area, but may become a

                     Storage or dumping area. 

                 R. Bissonnette:      Old Academy is a private road.  The new owners will need to be part of the Old Academy Association  

                     and pay maintenance fees, as well as join their own Association. 

             K. Greene:  If new development part of their Association, would they have access to the Old Academy common land?   Both

                     S. Ruggiano and G. Brault mentioned that it would be a benefit, to have more people pay into the Association. 

                R. Ertl:  Drainage and storm water concerns.

9:10 PM  B. Murphy made a motion to approve the Preliminary Plat as submitted, with the action items and/or changes to the project as noted.  M. Varney second.  All in favor. 

 

 

ACTION ITEMS:

                1. Municipal Sewer Plan to be submitted to Select Board for approval.

                2. Final Plat to show a boundary for the common land – possible hedge rows.  Remove pathway to common land.

                3.  Draft copy of Covenants:

                                Side walk maintenance

                                Road maintenance

                                Restrictions for common land use.

                             Encourage natural landscaping in common land.

                                Mention of participation in Old Academy Association as well as their  own Association

                4.  Determine who has controlling interest in the Old Academy Association.  The Board would like a written agreement

                   between the Hennings, and whoever is in charge of the Old Academy Street Association, giving permission and stating

                   terms, for connection to Old Academy Street and to the existing sewer line system.

                5.  Consider a way to divert more storm water to the retention pond instead of draining into the school area.

                6.  Commitment to fixing Old Academy Street if heavily damaged by construction vehicles.
